Just when you think that the book on Kendrick Lamar and Drake has been closed, a new chapter begins. And the latest installation comes courtesy of the legal battle between Drake and Universal Music Group.
Drake, UMG Ordered to Mediation Over ‘Not Like Us’ Lawsuit
In October, a judge ruled to dismiss Drake’s defamation lawsuit against the music label. Regarding their distribution of Lamar’s hit record, Not Like Us.
According to a November 17 report from AllHipHop‘s Grouchy Greg Watkins, a Judge has ordered the two parties to participate in a three-hour mediation on December 19.
According to the outlet, both Drake and UMG must be “prepared to discuss the legal strength of their positions, potential settlement options, and whether any issues can be narrowed or clarified.”
After Not Like Us, became one of the biggest anthems in recent memory, Drizzy took legal action against UMG. Accusing them of defamation. He alleged that they conspired to execute a mass promotion of the song. Particularly, the lyric where he is referred to as a “certified pedophile”
In Judge District Judge Jeannette Vargas, she ruled that Kendrick’s song could not be considered defamatory. Noting that the record was more of a “non-actionable opinion” than anything else.
“The fact that the Recording was made in the midst of a rap battle is essential to assessing its impact on a reasonable listener,” Vargas wrote in her ruling (via Variety). “Even apparent statements of fact may assume the character of statements of opinion. When made in public debate, heated labor dispute, or other circumstances in which an audience may anticipate the use of epithets, fiery rhetoric, or hyperbole.”
UMG has stood firm in its position. And after a judge dismissed the Grammy-winner’s initial lawsuit, they appear to hold all of the cards concerning this case. It will be interesting to see what the outcome of the upcoming mediation will be.
