Flock, real name Kevin Perez, was convicted on federal racketeering charges in a New York court on Thursday (March 20). The jury returned “mostly—but not all—guilty verdicts” on the second day of deliberations, according to Inner City Press.
The New York rapper was convicted of racketeering conspiracy, use of a firearm resulting in death, attempted murder and assault with a dangerous weapon in aid of racketeering, and the use of a firearm for attempted murder and assault with a dangerous weapon – He was acquitted on a charge of murder in aid of racketeering.
Acting U.S. Attorney Matthew Podolsky didn’t hold back in celebrating the conviction.
“[Kay Flock] instilled fear across the community with his violent actions, and then threatened rivals, bragged about shootings, and taunted victims in his rap lyrics,” Podolsky said. “But as a unanimous jury has now found, Perez can no longer hide behind his music, and instead will be held to account for his violent crimes.”
Kay Flock was initially charged in a multi-person federal RICO indictment in February of 2023 while he was in custody for the 2021 murder of Hwascar Hernandez. Hernandez was shot in the neck and back outside of a Harlem barbershop on Dec. 16, 2021. The NYPD reported that Hernandez ran out of the barbershop when Flock passed by. The rapper’s attorneys claimed the shooting was in self-defense.
Authorities say Flock and seven other alleged Sev Side and Third Side gang members—Devon Mason, Ervin Beamon, Nicholas Johnson, Jossi Castro, Iszayah Rowson, Mitchell Grant and Sean Smith—committed a murder and several shootings in The Bronx from June of 2020 to February of 2022.
Sentencing is scheduled for July 16.
