Tay-K Wins Shocking Ruling, Gets Murder Case Paused Temporarily

A couple of months ago, reports surfaced that Tay-K had a chance of coming home, leaving fans baffled. Complex reported on the first victory in Tay-K’s long quest to try and go home.

What Ruling Did Tay-K Win?

Tay-K’s legal team asked for a temporary halt of his appeal concerning his conviction in a San Antonio murder case, where he received 80 years in prison, in order to get details about the legality of an old search warrant.

Tay-K’s team wanted clarity on a search warrant for an iPhone that law enforcement found inside a car that they believed was associated with the murder of photographer Mark Anthony Saldivar.

During the rapper’s trial, he filed a motion to suppress the results of the search, arguing that authorities did not have probable cause. That motion was denied by the trial court.

Tay-K requested that the trial court “make written findings of fact and conclusions of law” to give the defense a clear reasoning as to why the evidence is amissable.

The Texas Fourth Court of Appeals agreed with the defense’s argument, giving the trial court 10 days to issue its findings and conclusions. Then, Tay-K’s appeal will restart. The rapper’s team will have to lay out a brief of their arguments, and the trial court will then decide if the evidence can be used, as the appeal restarts.

What Is The Appeal?

Their appeal argues that his alleged accomplish, Joana Reyes, is not a trustworthy witness in the trial. Reyes testified that Tay-K’s bullet killed Saldivar. In the appeal, the rapper’s lawyers allege that prosecutors fudged Reyes’ legal record to give her false credibility.

They argue this leverages a misrepresentation of the facts and therefore reduces her credibility. If they win this ruling, it could severely swing the case in Tay-K’s favor, opening up a chance for a mistrial, plea deal, or even an outright win.

Tay-K still has another case, where he was convicted of breaking into Ethan Walker’s home and murdering him. That case carries a 55-year sentence.
