Judge Makes Final Call on R. Kelly’s Request to Be Released Following Overdose

Incarcerated former R&B star R. Kelly was rushed to the emergency room on June 13. The Chocolate Factory creator suffered a “life-threatening” overdose.

After the near-fatal overdose, Kelly and his attorney had requested that he be released to home detention, citing that his life is in danger at FCI Butner, where he is currently serving his sentence. Unfortunately for R. Kelly, he won’t be getting released from prison.

Judge Denies R. Kelly’s Motion to Be Released From Prison

On Thursday, June 19, U.S. District Judge Martha Pacold, denied his request. Citing that he has not “demonstrated a legal basis” for the court’s jurisdiction.

“Kelly is currently housed at FCI Butner, which is located in Butner, North Carolina—outside this judicial district,” Pacold wrote. “Kelly has not demonstrated a legal basis for this court’s jurisdiction. Accordingly, his emergency motion … is denied.”

According to Kelly’s attorney, Beau B. Brindley, the former R&B star’s overdose was caused by prison medical staff. They served R. Kelly an enhanced dosage while he was in solitary confinement.

“That means that, within two days of the filing of his motion, Bureau of Prisons officials administered an amount of medication that significantly exceeded a safe dose and caused Mr. Kelly to overdose, putting his life in jeopardy,” Brindley said in an exclusive statement to AllHipHop. “They gave him an amount of medicine that could have killed him.”

However, the prosecutors in his case are not buying it. They believe Kelly’s emergency motion is just his latest ploy to deflect responsibility. They also say that he is using the incident as an opportunity to “promote himself,” in hopes of being released.

“Kelly refuses to accept responsibility for years of sexually abusing children and is using this Court’s docket merely to promote himself despite there being no legal basis to be before this Court,” prosecutors wrote earlier this week.

In September 2021, the former R&B star was convicted of nine counts of racketeering. Specifically related to him being the head of a sex trafficking ring involving young children. He was sentenced to serve a 30-year prison sentence. However, despite his conviction, Kelly has maintained his innocence throughout the legal process.
